Please read these Terms of Service ("Terms") carefully before using AutomatikPro ("the Service," "Platform," or "we/us"). By creating an account or using the Platform in any way, you agree to be bound by these Terms. If you do not agree, do not use the Service.
AutomatikPro is an AI-powered marketing automation platform designed for local service businesses. The Platform provides tools including CRM workspace, automated SMS and email follow-up sequences, AI chat widget, review collection and management, ad performance monitoring, and audience synchronization across advertising platforms.
AutomatikPro is built on and powered by GoHighLevel infrastructure, one of the most widely used CRM platforms for agencies and service businesses. Your data is stored and processed through GoHighLevel's systems in addition to AutomatikPro's proprietary systems.
The Service is intended for business use only. By using AutomatikPro, you represent that you are using it to market a legitimate business and not for personal, household, or consumer purposes.

You are responsible for all activity that occurs under your account, whether or not you authorized it. AutomatikPro reserves the right to refuse service to anyone at our sole discretion.
AutomatikPro offers a 30-day free trial to new accounts. During the trial period:
AutomatikPro reserves the right to modify trial terms, duration, or feature access at any time with notice. Trial accounts inactive for 30+ days from registration may be reclaimed.
Upon upgrading to a paid plan, a valid credit card or payment method is required. You authorize AutomatikPro to charge your payment method on a recurring monthly basis for the selected plan.
AutomatikPro offers the following subscription plans, billed monthly:
You may cancel your subscription at any time by contacting support@automatikpro.com or through your account settings. Cancellations require 30 days' notice. You will continue to have access to the Platform through the end of your current billing period. No refunds are issued for partial billing periods.
By using AutomatikPro, you agree that you will NOT:
Violation of this Acceptable Use Policy may result in immediate suspension or termination of your account without refund. AutomatikPro may report illegal activity to appropriate authorities.
SMS Compliance Responsibility: You are solely responsible for maintaining proper opt-in records, honoring opt-out requests immediately, and complying with all applicable messaging laws. AutomatikPro provides the tools; compliance with messaging regulations is your responsibility.
Your use of AutomatikPro is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the data practices described in the Privacy Policy.
You retain ownership of all data you upload to or generate through AutomatikPro, including your contact lists, campaign content, and customer data ("Your Data"). You grant AutomatikPro a limited, non-exclusive license to use Your Data solely to provide and improve the Service.
We do not sell Your Data to third parties. We may share data with service providers as described in our Privacy Policy, including GoHighLevel, Stripe, Twilio, and Google.
The AutomatikPro Platform, including all software, designs, text, graphics, logos, workflows, and automation templates, is the intellectual property of AutomatikPro and is protected by applicable copyright, trademark, and intellectual property laws.
You may not copy, reproduce, distribute, modify, or create derivative works of any portion of the Platform without our express written consent.
AutomatikPro does not claim ownership of content you create using the Platform (e.g., your SMS messages, email campaigns, or custom workflows). That content belongs to you.
AutomatikPro aims to maintain high platform availability but does not guarantee any specific uptime percentage or service level agreement (SLA), particularly for trial accounts. Paid subscribers on the Grow and Scale plans receive priority support and best-effort uptime restoration.
We reserve the right to perform scheduled and unscheduled maintenance that may temporarily affect Platform availability. We will provide advance notice of planned maintenance when reasonably possible.
AutomatikPro is not liable for any interruptions in service caused by third-party infrastructure providers including GoHighLevel, Twilio, Stripe, or cloud hosting providers.
Either party may terminate the subscription relationship:
Data Deletion: After account cancellation or termination, your data will be retained for 30 days, during which you may request an export. After 30 days, your data will be permanently deleted from our systems. AutomatikPro is not responsible for any data loss after this 30-day retention window.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AUTOMATIKPRO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM.
IN NO EVENT WILL AUTOMATIKPRO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING UNDER THESE TERMS EXCEED THE TOTAL FEES YOU PAID TO AUTOMATIKPRO IN THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
You agree to indemnify, defend, and hold harmless AutomatikPro and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any applicable law; or (d) any content you submit through the Platform.
These Terms are governed by the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in Orange County, Florida.
Before initiating any legal action, both parties agree to attempt to resolve disputes informally by contacting support@automatikpro.com with a written description of the dispute. We will attempt to resolve the issue within 30 days.
AutomatikPro reserves the right to modify these Terms at any time. We will notify you of material changes by email and/or by posting a notice on the Platform at least 14 days before changes take effect. Your continued use of the Platform after the effective date of updated Terms constitutes your acceptance of the changes.
Entire Agreement: These Terms, together with the Privacy Policy and any order forms or plan descriptions, constitute the entire agreement between you and AutomatikPro.
Severability: If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.
Waiver: AutomatikPro's failure to enforce any provision of these Terms shall not be construed as a waiver of that provision.
Assignment: You may not assign your rights under these Terms without our prior written consent. AutomatikPro may assign these Terms in connection with a merger, acquisition, or sale of assets.
